Rule Amendments

At their April meeting, the Benchers of the Law Society of Alberta approved amendments to the Rules regarding applications under section 37(4) of the Legal Profession Act, specifically rules 47.1, 48.4 and 64. These applications, previously considered by the Credentials and Education Committee, will now be considered by the Executive Director of the Law Society and may be appealed to the Committee. In addition to these Rule amendments, a protocol has been developed to provide clarity and guidance for section 37(4) applications regarding articling and CPLED requirements. The protocol provides information on the minimum requirements that must be met to make an application and the factors that may be considered in the application.

 

The Benchers also approved amendments to the Rules to clarify the appeal process for a decision by the Executive Director, and establish that the Executive Director’s decision will be reviewed for reasonableness. Additionally, amendments to the Rules clarify the process for hearings by the Credentials and Education Committee, including that an oral hearing shall be a private proceeding. 

 

Applicants to the Law Society of Alberta, who have either a law degree from a Canadian civil law degree program or a non-Canadian law degree, are required to have their law degree evaluated by the Federation of Law Societies' National Committee on Accreditation (NCA). Rule 50.2 has been amended to provide that the NCA’s decision is final.
